The rules and conditions for using OnestQR to create, edit, and track dynamic QR codes.
These Terms of Service ("Terms") govern your access to and use of the OnestQR website, applications, APIs, and related services (collectively, the "Service") operated by OnestQR ("we," "us," or "our"). Please read them carefully.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
OnestQR provides tools to create, customize, edit, and manage dynamic QR codes, including scan analytics, dashboards, and optional paid features. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, subject to applicable law and any active paid subscription terms.
You must be at least 16 years old and able to form a binding contract to use the Service. By using OnestQR, you represent that you meet these requirements and that all registration information you provide is accurate and current.
You may create QR codes without a traditional signup by using a Guest account secured with four secret access words. You are solely responsible for keeping your access words and recovery file confidential. We are not liable for lost access resulting from failure to store your credentials safely.
Member accounts require registration with a valid email address. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us promptly at [email protected] if you suspect unauthorized access.
You agree not to use the Service to:
We may investigate violations and suspend or terminate access at our discretion.
You retain ownership of the content you submit, including URLs, labels, and design assets ("Your Content"). You grant us a non exclusive, worldwide, royalty free license to host, process, display, and transmit Your Content solely to operate and improve the Service, including redirecting scans and generating analytics.
You are solely responsible for Your Content and the destinations linked from your QR codes. You represent that you have all necessary rights to use and share that content and that it does not infringe intellectual property or other rights of any third party.
The Service, including software, design, branding, documentation, and underlying technology, is owned by OnestQR or its licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features except as needed to use the Service in accordance with these Terms.
QR code images you generate for your own lawful use may be used by you subject to these Terms and any applicable open source or third party library licenses embedded in our generator.
OnestQR offers free access with optional Member and Pro subscriptions. Plan features, limits, and pricing are described on our Pricing page and may change over time. New pricing typically applies at renewal unless otherwise stated.
Paid subscriptions renew automatically until canceled. You may cancel through your account settings or by contacting us. Fees are generally non refundable except where required by law or explicitly stated at purchase.
Dynamic QR codes may record scan events such as time, device type, browser, and approximate location. Analytics are provided for your information and may be aggregated or limited based on your plan. You are responsible for using analytics in compliance with applicable privacy laws and for providing any required notices to people who scan your codes.
The Service may integrate with or link to third party payment processors, hosting providers, and destination websites. We are not responsible for third party products or services. Your use of those services is governed by their own terms and policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error free, secure, or that QR codes will always resolve correctly. You use the Service at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONESTQR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (USD $50).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless OnestQR and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your violation of these Terms, or your violation of any third party rights.
We may suspend or terminate your access to the Service at any time if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service. You may stop using the Service at any time. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and indemnification.
Before filing a formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally within 30 days. If we cannot resolve the dispute, it will be governed by the laws of the jurisdiction in which OnestQR operates, without regard to conflict of law principles, except where mandatory consumer protection laws in your country provide otherwise.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes may be communicated through the Service or by email. Continued use after changes become effective constitutes acceptance of the revised Terms.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and OnestQR regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of that provision.
